Terms of Service

1. Acceptance of Terms

By accessing or using Silenced ("the Platform"), including the desktop application, web client, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Eligibility

You must be at least 13 years of age to use Silenced. By using the Platform, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the Platform.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide a valid email address and accurate information when creating your account
• Enable and maintain multi-factor authentication (MFA), which is required for all accounts
• Keep your password and MFA credentials secure and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Not create accounts for the purpose of violating these Terms

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use Silenced in a lawful and respectful manner. You may not use the Platform to:

• Engage in any illegal activity or promote illegal conduct
• Distribute malware, viruses, or any harmful software
• Harass, bully, threaten, or intimidate other users
• Share content that exploits or endangers minors in any way
• Distribute child sexual abuse material (CSAM) — this will result in immediate and permanent account termination and may be reported to law enforcement
• Send spam, unsolicited messages, or engage in phishing
• Impersonate other individuals or entities
• Attempt to gain unauthorized access to other accounts, servers, or systems
• Interfere with or disrupt the Platform's infrastructure
• Scrape, crawl, or use automated means to access the Platform without permission
• Sell, trade, or transfer your account to another person
• Use the Platform to coordinate or carry out fraud, money laundering, or terrorist activities
• Distribute copyrighted material without authorization
• Engage in doxxing, swatting, or sharing others' personal information without consent
• Evade bans or suspensions by creating new accounts

5. Content & User Responsibility

You retain ownership of any content you create and share on Silenced. By posting content, you grant us a limited, non-exclusive license to store and transmit that content solely for the purpose of operating the Platform.

Silenced is a platform that provides a space for users to communicate freely. We are not responsible for any content posted, shared, or transmitted by users on the Platform. All content is the sole responsibility of the user who created it. We do not endorse, verify, or assume liability for any user-generated content, communications, or activities that occur on the Platform.

We do not monitor, pre-screen, or review the content of private messages. However, we may investigate and take action on reported content that violates these Terms.

Community owners and moderators are responsible for managing content within their communities and enforcing their own rules, provided those rules do not conflict with these Terms.

6. Enforcement & Termination

Violations of these Terms may result in actions including but not limited to:

• Warning or notice of violation
• Temporary suspension of your account
• Permanent termination of your account
• Removal of content that violates these Terms
• Reporting to law enforcement where legally required or appropriate

Severe violations — including distribution of CSAM, terrorism-related activity, credible threats of violence, or other serious illegal conduct — will result in immediate and permanent account termination without prior warning.

We reserve the right to terminate any account at our sole discretion, with or without notice, for any reason.

7. Privacy

Your use of Silenced is also governed by our Privacy Policy, which describes how we handle your data. We are committed to collecting as little data as possible and never selling your information.

8. End-to-End Encryption

Voice and video calls on Silenced are end-to-end encrypted. This means we cannot access the contents of your calls. While encryption protects your communications, it does not exempt you from complying with these Terms. Abuse of encrypted features for illegal purposes is still a violation and may result in account termination.

9. Availability & Changes

Silenced is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Platform at any time without notice.

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

10. Intellectual Property

The Silenced name, logo, and all associated branding are our property. You may not use our trademarks without prior written permission. The Platform's source code, design, and infrastructure are proprietary.

11. Limitation of Liability

Silenced provides a platform for communication. We are not responsible or liable for any interactions, disputes, content, or outcomes that arise from the use of the Platform. Users communicate at their own risk, and we bear no responsibility for what users say, share, or do on the Platform.

To the maximum extent permitted by law, Silenced and its operators shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. This includes but is not limited to loss of data, loss of profits, damages resulting from unauthorized access to your account, or any harm resulting from content or conduct of other users.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Silenced, its operators, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your content, or your violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where Silenced operates.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
